In 1973, the Supreme Court decided in Roe v. Wade that a Texas state law restricting access to abortion was unconstitutional. If that decision were to be overturned by a future Supreme Court case (something anti-abortion advocates are working toward), states could once again enforce such laws.

Though for years legal scholars have argued whether or not Roe qualifies as “settled law” (a term that is something of a misnomer), Donald Trump’s nomination of Amy Coney Barrett to fill the Supreme Court seat left vacant by the death of Justice Ruth Bader Ginsberg has raised both fears and, for some, eager anticipation that a 6-3 conservative majority court will see fit to reverse the nearly 50-year-old ruling. But if the court does indeed reverse course, what will happen?

As the Guttmacher Institute and the Washington Post report, some states have pre-Roe abortion laws on the books, while others have passed laws intended to take effect if Roe is ever overturned. But other states have passed laws specifically to keep abortion legal in that case. So the legality of abortion would depend on which state you live in, as this chart from Guttmacher illustrates. Here are some, er, highlights:

  • States with “trigger laws” that would automatically ban some or all abortions: Arkansas, Idaho, Kentucky, Louisiana, Mississippi, Missouri, North Dakota, South Dakota, Tennessee and Utah.
  • States with pre-Roe abortion bans still on the books: Alabama, Arizona, Arkansas, Michigan, Mississippi, New Mexico, Oklahoma, Wisconsin, and West Virginia.
  • States with laws that describe an intention to pass (more) anti-abortion laws: Arkansas, Kansas, Kentucky, Louisiana, Missouri, North Dakota, and Ohio.
  • States with laws that explicitly protect abortion: California, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Nevada, New York, Oregon, Rhode Island, Washington and Vermont. (It’s not a state, but Washington, D.C. has also passed laws protecting the right to abortion throughout pregnancy.)
